Background

A landlord sought eviction of his tenants from a shop premises in Lucknow over non-payment of rent, after earlier notices terminating the tenancy and demanding arrears. The trial court decreed eviction and recovery of rent arrears in the landlord's favour in 1992, but the tenants' second appeal succeeded before the Allahabad High Court (Lucknow Bench) in 2018, which held that the tenancy-termination notices were not validly served or had been effectively waived by the landlord's later conduct.

Decision Breakdown

The Supreme Court held that the High Court's reasoning on waiver of the earlier notice was legally unsound, since a later notice (of April 1974) referring back to and reinforcing the earlier demand could not be read as forgiving it, and there was no evidence on record that the tenants had failed to receive that notice. The Court restored the trial court's decree of eviction and rent recovery with interest. However, taking into account that the tenants had been in possession for nearly three decades, the Court granted them time until 30 September 2020 to vacate, conditional on filing an undertaking and clearing all rent arrears and continuing to pay rent in the meantime.

Lesson Learnt

A tenant cannot escape eviction by claiming a landlord's later, firmer rent-demand notice somehow "revived" or implied forgiveness of an earlier termination notice: courts will look at the substance and continuity of the landlord's demands, not technical gaps between successive notices.
