Background

The case arises from the 2019 murder of Y.S. Vivekananda Reddy, brother of a former Andhra Pradesh Chief Minister. The appellant is the deceased's daughter. After the CBI took over the investigation and its charge sheets implicated a widening circle of people (including, per the CBI's own affidavit, evidence pointing toward the first respondent Y.S. Avinash Reddy, a relative of the deceased and an elected politician), the CBI issued him notices to appear for questioning as it prepared to potentially arrest him. He sought anticipatory bail and interim protection from the Telangana High Court, which passed an order restraining his arrest and directing that his CBI questioning be conducted only through written/printed questions and answers, with a questionnaire handed to him in advance. The daughter appealed this order to the Supreme Court.

Decision Breakdown

The Supreme Court held that the High Court's directions were premature and unwarranted, especially given what the CBI's own affidavit already showed about a suspect's alleged role in the conspiracy and destruction of evidence. The Court found it "wholly inappropriate" for a court, at the mere interim/ad-interim stage (before even deciding the actual anticipatory bail application), to dictate that a criminal investigation be conducted only through written questions with an advance questionnaire: such conditions could seriously undermine and "stultify" a genuine investigation. The Supreme Court set aside the High Court's order but clarified that the actual anticipatory bail application could still be decided by the High Court on its own merits, unaffected by this ruling. It also extended the CBI's deadline to complete its investigation to 30 June 2023.

Lesson Learnt

Courts must be cautious about micromanaging a live criminal investigation through interim orders (like insisting on written-only questioning) before the substantive bail issue is even decided, doing so can seriously hamper investigators' ability to get truthful, spontaneous answers from a suspect.
