Background

The appellants challenged a Calcutta High Court judgment (dated 30.11.2006) in a writ appeal, which had already ruled mostly in their favour except for a part relating to "divesting" of certain rights. The dispute concerned possession of property and payment of charges for its continued use and occupation by the Union of India.

Decision Breakdown

During the hearing, the Court recorded that the respondents (Union of India) agreed to surrender vacant possession of the property by 31 March 2020, clear all outstanding dues within one month, and continue paying the existing use-and-occupation charges until possession was handed over. The Court disposed of the appeal on these agreed terms, directed the respondents to file a formal undertaking to this effect within a month, and closed all pending applications with no order as to costs. Notably, the Court expressly left the underlying question of law raised in the appeal open rather than deciding it.

Lesson Learnt

Parties in litigation can resolve a dispute through a negotiated, time-bound arrangement recorded by the Court, which disposes of the case practically even without the Court ruling on the broader legal question involved.
