Background

This is a referral order, not a final judgment. A large batch of appeals, writ petitions and contempt petitions concerned the Employees' Pension Scheme run by the EPFO. The question was whether paragraph 11(3) of the Scheme sets a cut-off date for opting into a higher pension, and whether the Court's earlier decision in R.C. Gupta should govern.

This is a referral order, not a final judgment. The two-judge bench did not decide the question. It directed the Registry to place all the matters before the Chief Justice to set up a bench of at least three judges. No relief was granted or refused.
