Background

An association representing nurses filed a writ petition seeking Supreme Court directions to improve the working conditions of nurses employed in private hospitals and nursing homes, to ensure they are paid salaries comparable to nurses in government hospitals, and to declare unconstitutional the practice of hospitals requiring nurses to sign employment "bonds."

Decision Breakdown

The Supreme Court agreed that nurses in private hospitals and nursing homes were not being treated fairly on pay and service conditions, but declined to lay down specific guidelines itself since the grievances needed expert examination. Instead, it directed the Central Government to constitute a committee within four months to study the issues and make recommendations within six months of its formation, which could then be given legislative effect by the Centre or the States. On the separate grievance about employment bonds, the Court noted the Indian Nursing Council's submission that the bond system had already been abolished, so that specific grievance no longer survived. The writ petition was disposed of with these directions.

Lesson Learnt

Courts do not always resolve systemic policy grievances by issuing detailed rules themselves; sometimes they finally dispose of a petition by directing the government to set up an expert committee to study the issue and report back, leaving the substantive policymaking to the executive while keeping it under a time-bound judicial push.
