Background

A Central Excise office superintendent faced disciplinary charges after allegedly leaving work, falsifying attendance and improperly checking passengers. Following criminal acquittal, earlier litigation left the attendance charge intact and required reconsideration of punishment. Dismissal was replaced with compulsory retirement, but the High Court later reopened the finding and ordered reinstatement with back wages.

Decision Breakdown

The Court allowed the Government's appeal and restored compulsory retirement from the original dismissal date, June 10, 1997. The finding on the attendance charge had already become final, so later litigation could challenge the substituted punishment rather than reopen guilt. The High Court had improperly reassessed the evidence as an appellate court instead of reviewing legality, fair procedure or a finding unsupported by any evidence. The penalty for dishonest falsification of records did not shock the conscience and could not be replaced merely because another view was possible. Because compulsory retirement substituted the earlier dismissal, it correctly operated from that dismissal date.

Lesson Learnt

A writ challenge to discipline addresses legal or procedural defects and extreme irrationality, rather than simply asking a court to weigh the evidence again. A finding already made final in earlier litigation cannot ordinarily be reopened when only punishment was sent back for reconsideration.
