Background

Air Force officers promoted to Group Captain by the time-scale route were required to retire earlier than Group Captains selected on merit. The Armed Forces Tribunal granted parity: retirement at 54 for the flying branch and 57 for ground duty. The Union argued that different promotion routes and operational needs justified the distinction.

Decision Breakdown

The Supreme Court dismissed the Union's appeals and upheld the tribunal. Both categories belonged to the same rank and cadre with broadly equal pay, status and benefits; the route of promotion did not justify unequal retirement ages. The claimed need for younger commanding officers was already achieved through earlier merit promotion and seniority. Assertions about distinct duties and reduced combat effectiveness were not substantiated enough to sustain the classification under Articles 14 and 16.

Lesson Learnt

An employer needs a sound, relevant justification for different retirement treatment within the same cadre. The fact that one employee reached a rank through faster merit promotion did not alone justify retiring an otherwise equal colleague earlier.
