Background

The purchasers of a bungalow in Pune Cantonment sued the government for possession and rent, treating it as their tenant under a repairing lease. The government maintained that the underlying land belonged to it and had been occupied under an old grant reserving a right of resumption. The lower courts nevertheless ordered the government to hand over the premises because it had failed to maintain them.

Decision Breakdown

The Court allowed the government's appeal, set aside the lower-court decisions and dismissed the possession suit. The grant records, sale documents and purchasers' admission certificate showed that they owned the buildings but not the land. The repairing lease expressly preserved the government's right to resume the property. Under the Government Grants Act, the grant's terms governed these rights, and the lower courts had wrongly treated the whole property as an ordinary landlord-tenant arrangement. An earlier litigation order had also preserved the government's right to seek dispossession in accordance with law.

Lesson Learnt

Buying a cantonment bungalow held on old-grant terms does not necessarily buy the land beneath it. The grant conditions and land register can preserve government ownership and resumption rights despite a private sale of the building.
