Background

A man convicted under Section 23 of the narcotics law received ten years' imprisonment for carrying alleged contraband. The High Court acquitted him, including on the ground that the prosecution had not established the required connection with import into or export out of India, and the Union appealed.

Decision Breakdown

The Court dismissed the Union's appeal and left the acquittal undisturbed. Section 23 addresses illegal import into India, export out of India and transhipment connected with those cross-border activities. Its use of transhipment could not be treated as covering every domestic movement of narcotics. Because that statutory basis for conviction was missing, the Court did not need to decide the High Court's other findings about proof of the substance or procedural compliance.

Lesson Learnt

A criminal conviction requires proof of the elements of the particular charged offence; suspected domestic drug transport does not by itself establish a cross-border offence.
