Background

Landowners challenged acquisition for Delhi's planned development after their objections were heard by one Collector but reported on by his successor. The High Court quashed the proceedings, and the Union appealed. The award dated from 1987, while physical possession remained with the owners when the new acquisition statute took effect in 2014.

Decision Breakdown

The Court dismissed the Union's appeals and upheld relief to the landowners. On the Section 24(2) interpretation applied in this judgment, the old award and absence of physical possession supported lapse, and depositing compensation with the revenue department was not deemed payment. On the merits too, the statutory objections required proper consideration by the officer who heard them; the successor had not afforded that hearing. The Court rejected the attempt to excuse the defect through a general prejudice argument. Connected orders followed the same reasoning, including allowing Vinod Kapur's appeal.

Lesson Learnt

An opportunity to object to compulsory acquisition must be meaningful and follow the statutory hearing process. These landowners obtained relief on their procedural facts and the lapse rule as interpreted in this 2014 judgment.
