Background

About 300 Junior Assistants were working with the University of Delhi on a contract basis, some since as far back as 2003, while regular recruitment for similar posts had been frozen for years due to a UGC ban. When the University finally advertised 255 regular posts in 2013, the contract employees' union sought regularization or, failing that, a fair chance to compete, arguing they should not be tested on the same footing as fresh applicants. The High Court's Division Bench agreed and directed the University to design a special, more appropriate test for them, which the University challenged before the Supreme Court while the Union cross-appealed seeking fuller relief.

Decision Breakdown

Applying the Constitution Bench ruling in Secretary, State of Karnataka v. Umadevi, the Supreme Court held that the contract employees could not claim regularization as a matter of right since they had not completed ten years of service without court protection by the 2006 cutoff date set in that precedent, and a separate test exclusively for contract employees (as the High Court had ordered) was also not appropriate since it would improperly narrow the pool of competition. Instead, the Court crafted a middle path: a single common selection test open to all candidates, but with full age relaxation for the contract employees and a sliding scale of bonus marks (from 8 up to 18 marks, capped at 6% of the 300 total marks) scaled to each employee's years of contract service, so that longer-serving employees received a greater advantage while still competing against new applicants.

Lesson Learnt

Long years of informal or contractual government service do not create an automatic right to permanent regularization, but courts can fashion a proportionate remedy, such as weighted bonus marks tied to experience, that gives such employees a meaningful, fair opportunity within a genuinely competitive selection process rather than either an automatic entitlement or no recognition at all.
