Vikartan Infrastructure had sought to enforce an arbitral award against Eco Green Buildtech. However, in a separate but connected proceeding, Eco Green Buildtech's own petition under Section 34 of the Arbitration and Conciliation Act, 1996 (challenging the same award) had already been allowed, and the underlying award itself had been set aside.
Since the award sought to be enforced had already been set aside in the Section 34 proceedings, there was nothing left for the Court to enforce. The Court accordingly disposed of the enforcement petition as infructuous, along with the pending application, without further orders.
An award-enforcement petition automatically becomes redundant once the underlying arbitral award itself is set aside in a separate challenge: enforcement and challenge proceedings on the same award are closely linked, and the outcome of one can dispose of the other.
