Civil Property & InheritanceSupreme Court of India

Vinod Kumar v. Ashok Kumar Gandhi

Civil Appeal · 2019 INSC 860Decided 5 Aug 2019
Civil Appeal No. 3793 of 2016
Justice Ashok Bhushan · Justice K.M. Joseph

Background

This order decides a preliminary point; it does not decide the appeals. Tenants facing eviction asked that Satyawati Sharma v. Union of India (2008), which allowed eviction of non-residential tenants for the landlord's bona fide need under the Delhi Rent Control Act, be referred to a larger bench.

Decision Breakdown

This is not a final judgment in the appeals. The Court rejected the request to refer Satyawati Sharma to a larger bench. It did not examine the Rent Controller's refusal of leave to defend, and directed that the appeals be listed for hearing on merits.

Lesson Learnt

Landlords in Delhi can continue to seek eviction of commercial tenants for bona fide need; these tenants' own cases were still to be heard.
