Background

A public servant was convicted of accepting a Rs. 265 bribe in a 1984 trap case. Registration, trial and appeal together took almost three decades. At the Supreme Court stage he was seventy-six, had health problems and had served about three months in custody; the appeal was limited to sentence.

Decision Breakdown

The Court maintained the conviction but reduced imprisonment to the period already served. The applicable 1947 corruption statute permitted a sentence below its minimum where special reasons were recorded. The extraordinary delay, advanced age, ill health and circumstances of this small-value trap case supplied those reasons. The Court instead imposed a Rs. 50,000 fine payable within three months, with six months' imprisonment if unpaid. The decision therefore changed punishment rather than overturning the finding of corruption.

Lesson Learnt

Exceptional delay and the offender's age and health can affect sentence where the applicable statute permits it. Such mitigation does not erase a corruption conviction or the obligation to pay the fine.
