Background

ANI Media sued Wikimedia Foundation and others in the Delhi High Court for defamation, and during that suit a Single Judge directed Wikimedia to disclose the identity of anonymous Wikipedia editors who had made certain edits. A Wikipedia article and its linked "talk page" discussed the case, reported a controversial remark attributed to the judge, and were later reported in press pieces as raising free-speech concerns. Taking strong exception to this, the Division Bench of the High Court held that hosting these pages amounted to interference with court proceedings bordering on contempt, and ordered Wikimedia to take the pages down within 36 hours. Wikimedia appealed to the Supreme Court against only that take-down direction.

Decision Breakdown

The Supreme Court set aside the High Court's take-down order, holding it was disproportionate and unreasoned. Surveying its precedents (including the Constitution Bench in Sahara India Real Estate and the live-streaming case Swapnil Tripathi), the Court reiterated that courts must remain open to public debate and even fair, sharp criticism, and that restricting speech about pending cases (a "postponement order") is justified only where there is a real and substantial risk of prejudice to a fair trial, not merely because a comment displeases the court. Fair criticism of a judgment or judge is not contempt; only scandalous or malicious attacks that genuinely obstruct justice attract that consequence. The Court expressly did not decide the underlying defamation suit or Wikimedia's claim to be a neutral intermediary, confining itself to the legality of the take-down direction.

Lesson Learnt

Courts cannot casually order the removal of online discussion or commentary about a pending case just because it is critical of a judge or an order: free speech about court proceedings is constitutionally protected unless it poses a real and substantial risk to a fair trial, and the burden of showing that risk lies with whoever seeks the restriction.
