Background

After two students died in an apparent road collision, one victim's father alleged a planned murder and sought an independent investigation. A senior officer recommended registering a murder case and investigating further, but successive police teams treated the event as an accident despite directions and proceedings in the High Court. The appellants challenged the High Court's order requiring action on the original officer's report.

Decision Breakdown

The Court found the replacement investigation teams improperly constituted and their actions inconsistent with the High Court's directions. It dismissed the appeal, removed the accident charge-sheet from the record, set aside the teams' reports and directed registration under Section 302 followed by a fair, transparent investigation by the Superintendent of Police. It increased compensation to the complainant father from ₹50,000 to ₹2.5 lakh, initially payable by the State and recoverable from responsible officials after accountability was fixed. It also required a Chief Secretary inquiry report within two months. The Court expressly did not decide whether the deaths were murders or accidents or whether any person was guilty.

Lesson Learnt

Investigating authorities must respect a court's existing supervision and cannot use replacement teams to nullify its directions. Ordering a murder investigation requires scrutiny of that allegation, rather than constituting a finding that murder occurred.
