Akalakunnam Village Service Co-operative Bank Ltd. v. Binu N.
Background
A Kerala co-operative bank advertised an attender post and three peon posts and appointed four candidates. Other applicants challenged the notification before the examination, alleging breaches of the Registrar's recruitment guidelines. The High Court quashed the recruitment and ordered a fresh selection. The bank and selected candidates disputed both that result and the availability of a writ remedy.
Decision Breakdown
The Court dismissed both appeals and vacated its interim stay. Guidelines issued under Rule 182(5) had statutory force, and the bank had not conducted the written examination and interview in accordance with them. The dispute with these applicants did not fall within Section 69's co-operative arbitration remedy. Their challenge also preceded the examination, so participation did not defeat it. The High Court's fresh-selection direction remained effective, including its temporary daily-wage arrangement for the selected candidates without any resulting preference in the new recruitment.
Lesson Learnt
Applicants can challenge a co-operative bank's recruitment when it breaches binding statutory guidelines. Raising the objection before the examination also avoids treating the challenge as mere dissatisfaction after selection.
