Anuj Kaushik & Ors. vs. State (N.C.T of Delhi) & Anr.
Background
The petitioners sought quashing of a 2022 FIR under Sections 498A/406/34 IPC (matrimonial cruelty and misappropriation of stridhan) after the complainant-wife reported that she had reconciled with her husband and his family.
Decision Breakdown
The complainant appeared in Court and personally confirmed to the judge in Hindi that she had compromised all disputes and had been living happily with the petitioners as a close family for about a year, along with her two daughters from the marriage, who were also living happily with the family. Given this genuine reconciliation and her clear wish not to continue the prosecution, the Court quashed the FIR and all related proceedings rather than push the family through a full trial.
Lesson Learnt
Where a matrimonial dispute has fully resolved itself through actual reconciliation and continued family life together (not merely a paper settlement), courts view this as a strong reason to quash the underlying criminal case in the interest of preserving the reunited family.
