Avjeet Singh Plaha vs. State Govt of NCT of Delhi & Anr.
Background
The petitioner sought quashing of a 2018 FIR under Sections 354/341/506/323 IPC after the complainant (his neighbour) informed the Court, via videoconferencing, that they had settled all disputes and were now living peacefully together. The State raised no objection, and statements of both parties had already been recorded by the Joint Registrar.
Decision Breakdown
Having personally spoken with the complainant in Hindi and being satisfied she genuinely wished to withdraw the complaint, the Court held it would serve the interest of justice not to force the parties through a full trial. The FIR and all connected proceedings were accordingly quashed.
Lesson Learnt
In cases involving personal disputes between neighbours (rather than serious, non-compoundable offences against society), courts will readily quash criminal proceedings once a genuine settlement is verified directly with the complainant.
