Central Bureau of Investigation v. Karimullah Osan Khan
Background
An accused in the 1993 Bombay bomb-blast conspiracy was arrested after remaining absconding for about fifteen years. The designated court framed narrower charges against him than the earlier common conspiracy charge and refused the CBI's application to add the omitted offences.
Decision Breakdown
The Court allowed the CBI's appeal and its application to alter the charges, directing the designated court to proceed according to law. The supplementary charge-sheet continued the original prosecution, and the earlier material, additional evidence and statutory confession could not simply be discarded. Courts may add or alter charges before pronouncing judgment when material supports the change, while following safeguards against prejudice to the defence. The order authorised the additional charges and did not decide guilt on them.
Lesson Learnt
An omission in framed criminal charges can be corrected before judgment when supported by the record, but the accused must receive the procedural protections needed to meet the changed case.
