Devender Kumar vs. State NCT of Delhi and Ors.
Background
The petitioner said he had received threatening calls purportedly from a notorious gangster, Kapil Sangwan @ Nandu, and had been given a police protection officer as a result. That protection was withdrawn in July 2026, and although he approached the district's Witness Protection Committee for restoration, he received no update on the outcome, even as a shooting incident occurred just 200 metres from his home.
Decision Breakdown
The Court directed that the petition itself be treated as a formal representation to the Witness Protection Committee, which was told to obtain a fresh threat-assessment report and pass appropriate orders, with the petitioner allowed to participate in that process. In the meantime, as an interim measure to address his genuine apprehension, the Court ordered the earlier police protection to be restored until the Committee took its own final decision, making clear this interim order should not influence the Committee's independent assessment.
Lesson Learnt
When an administrative body like a Witness Protection Committee is slow to decide on a genuine safety concern, courts can step in to order interim protective measures while the proper decision-making process, with its own expert threat assessment, is allowed to run its course.
