Dilip Kumar & Anr. vs. State of NCT of Delhi & Anr.
Background
The petitioners sought quashing of a 2022 FIR under Sections 498A/406/34 IPC after the complainant (daughter-in-law of one petitioner) confirmed the family dispute had been resolved. She stated she had been living happily with the petitioners as a close family for about a year, and that a son born from her marriage to petitioner no. 1 was also living happily with the family.
Decision Breakdown
Having personally spoken with the complainant in Hindi and finding her wish to withdraw genuine, the Court held it would be in the interest of justice not to subject the family to a full trial given the reconciliation already achieved. The FIR and connected proceedings were quashed.
Lesson Learnt
Where a matrimonial cruelty complaint has genuinely dissolved into family reconciliation, with the couple and their child living together again, courts favour quashing the FIR over forcing a disruptive trial.
