Dilipkumar v. The State of Maharashtra
Background
While deciding the appellant's anticipatory bail application under Section 438 Cr.P.C., the High Court went beyond the bail question and additionally directed that Rs. 10,00,000, a cost amount that the Supreme Court had earlier awarded in an unrelated Civil Appeal (No. 2374/2010), be recovered from the appellant. The appellant, who had by then already been granted regular bail after arrest, challenged only this cost-recovery direction before the Supreme Court.
Decision Breakdown
The Supreme Court held that the High Court had "gravely gone wrong" in ordering recovery of the Rs. 10,00,000, because that issue did not even arise in the bail proceeding before it, and it was not open to the High Court to collaterally decide who should bear costs awarded by the Supreme Court in a completely separate case. The Court allowed the appeal and vacated the recovery order, disposing of any pending applications.
Lesson Learnt
A court deciding one specific application (such as a bail plea) cannot use that proceeding to decide unrelated issues, like liability for costs awarded in a different case altogether: judges must stay within the scope of the matter actually before them.
