Dinesh Kumar Sharma & Anr. vs. The State Govt of NCT of Delhi and Anr.
Background
An FIR was filed in 2021 alleging the petitioners repeatedly misbehaved with, abused, and threatened the complainant and tried to force open her residence's door: registered under Sections 509/506/34/354(D) IPC, with a chargesheet filed in 2024. The parties later signed a Memorandum of Undertaking (20.09.2026) in which the petitioners agreed to have no further contact with her.
Decision Breakdown
The complainant confirmed she accepted the petitioners' apology and no longer wished to pursue the matter; the Court quashed the FIR but, at the State's request given the nature of the offences, directed the petitioners to deposit Rs.30,000 as cost with the Delhi High Court Bar Association's Lawyers Welfare Fund.
Lesson Learnt
Even where an FIR is quashed on settlement, courts can still impose a monetary cost on the accused as a deterrent, particularly in cases involving harassment of a woman.
