Dinubhai Boghabhai Solanki v. State of Gujarat and Others
Background
An environmental and right-to-information activist was murdered while pursuing allegations of illegal mining near Gir Sanctuary. His father challenged the state police investigation as biased and incomplete. The High Court transferred further investigation to the CBI, and a suspect challenged that transfer and related observations.
Decision Breakdown
The Court dismissed the challenges and upheld the CBI investigation because the recorded investigative omissions justified concern about impartiality. A suspect did not have a general right to choose the investigating agency or to be heard before such an investigative direction. The High Court's observations explained the transfer and were not findings of guilt; the trial had to remain uninfluenced by them. Separately, the Court granted the appellant conditional bail after the supplementary charge-sheet, considering that investigation was complete and trial could be lengthy. His position as a sitting MP conferred no special entitlement.
Lesson Learnt
An investigation can be transferred when substantial shortcomings undermine confidence in its fairness. Such a transfer does not establish guilt, and public office does not give an accused special treatment in bail decisions.
