Dr. Subramanian Swamy v. Raju through Member, Juvenile Justice Board
Background
Following the fatal December 2012 Delhi sexual assault, one accused was dealt with by the Juvenile Justice Board because he was under eighteen. Petitioners, including the victim's parents in connected proceedings, sought adult criminal proceedings for sufficiently mature juveniles accused of serious crimes.
Decision Breakdown
The Court dismissed the appeal and writ petition. The Juvenile Justice Act, 2000 clearly placed all persons under eighteen in the juvenile system, and the Court could not add an exception based on perceived maturity or the seriousness of an offence. That age-based classification was constitutionally permissible and supported the statute's rehabilitative purpose. The juvenile system still enforced criminal law through different procedures and sanctions; whether to change that legislative policy was for Parliament rather than judicial rewriting.
Lesson Learnt
Courts apply a clear statutory age rule as enacted; public concern about a serious offence does not authorise them to invent an adult-trial exception that the governing law lacks.
