G.N. Verma v. State of Jharkhand
Background
After a fatal accident at Karkata Colliery, a mines inspector alleged that coal extraction had continued despite a safety prohibition. Chief General Manager G.N. Verma was prosecuted alongside the mine's agent and manager, although the complaint did not explain his involvement in the prohibited work. The High Court refused to quash the case by treating him as a deemed agent.
Decision Breakdown
The Supreme Court allowed Verma's appeal and quashed the complaint against him. His senior designation alone did not establish that he acted for the owner in managing, controlling or supervising the particular mine, and the complaint alleged no facts connecting him to the offence. The statutory and regulatory provisions could not be stretched to impose criminal responsibility merely because he was chief general manager. The Court also highlighted how routine transfer of original records had stalled the trial for over thirteen years despite there being no stay.
Lesson Learnt
A senior job title alone does not establish criminal liability for a mine-safety violation; the complaint must identify facts placing that person within the statutory responsibility.
