Gold Quest International Pvt Ltd v. State of Tamil Nadu
Background
Customers complained that a company had received money without delivering promised collectible gold coins, prompting a cheating and prohibited money-circulation investigation. A High Court judge quashed the FIR after settlement of the customers' monetary claims. The appellate bench revived the investigation, relying partly on the absence of settlements from two customers whose whereabouts were unknown.
Decision Breakdown
The Supreme Court allowed the company's appeal and restored the order quashing the FIR. The record sufficiently showed settlement of the complainant's and other affected customers' claims; the two untraced people had not challenged the earlier order. The Court applied the power to end proceedings arising substantially from private civil disputes when settlement left no realistic prospect of conviction. It expressly distinguished serious offences and offences with wider public consequences, which cannot be disposed of merely because individuals compromise.
Lesson Learnt
A genuine settlement can support quashing a criminal case arising from a private monetary dispute. It does not create a general right to stop prosecution for serious crimes or offences affecting the public.
