Gurwinder Singh @ Sonu Etc. v. State of Punjab and Anr.
Background
Two families in a Punjab village had a long-running land dispute, worsened by an unrelated quarrel over a missing dog. During a gathering meant to settle the land dispute, heated words led to a scuffle; appellant Gurwinder Singh fetched an axe from a nearby room and struck Harbhajan Singh on the head, who died about a month later. Both the trial court and the High Court convicted Gurwinder Singh and his father Satnam Singh of murder under Section 302 IPC (read with Section 34) and sentenced them to life imprisonment.
Decision Breakdown
The Supreme Court found that the fight was sudden and unpremeditated, arising from a chance quarrel during settlement talks, that both sides were unarmed until the accused fetched the axe, that the accused themselves sustained injuries in the same scuffle (which the prosecution never explained), and that the deceased survived for about a month after the injury, all pointing to the case falling under Exception 4 to Section 300 IPC (sudden fight, no undue advantage taken). However, since the head injury inflicted with an axe was objectively "sufficient in the ordinary course of nature to cause death," the offence could not be reduced below Section 304 Part I IPC (culpable homicide with intention to cause such an injury). The Court therefore modified the conviction from murder (Section 302) to Section 304 Part I, reduced the sentence to seven years' imprisonment, and ordered Gurwinder Singh's immediate release since he had already served over ten years, while directing Satnam Singh to surrender to serve his remaining sentence.
Lesson Learnt
A killing arising from a sudden, unplanned fight, especially where both sides traded blows and sustained injuries, can be treated as culpable homicide rather than murder even where a weapon was used, but if the injury inflicted was objectively severe enough to be fatal in the ordinary course, the accused will still face a substantial sentence under Section 304 Part I, not a full acquittal.
