Istkar vs. The State of Uttar Pradesh
Background
Ahead of Panchayat elections, the appellant, a daily-wage earner, was required under Section 107 CrPC to furnish a personal bond of Rs. 5,00,000 to keep the peace. After the elections were over, he was accused of obstructing revenue officials during an inspection of an alleged illegal construction on public pond land and using indecent language with them. On this basis, the Sub-Divisional Magistrate forfeited his entire Rs. 5,00,000 bond ex parte, an order upheld first by the Sessions (Revisional) Court and then by the Allahabad High Court under Article 227.
Decision Breakdown
The Supreme Court held that the preventive-security provisions of Chapter VIII CrPC exist solely to avert future breaches of peace, not to punish or to swell the state's coffers, and the bond amount must, under the proviso to Section 117, never be excessive or disconnected from the person's circumstances. It noted that the underlying election-related peace concern had already lapsed by the time of the alleged violation, that the appellant was never given a proper opportunity to defend himself against the obstruction allegation, and that the maximum punishment for the offence actually alleged (Section 186 IPC, obstructing a public servant) is only three months' imprisonment or a Rs. 500 fine. Weighing the appellant's status as a daily-wage earner, the disproportionality between the alleged conduct and a Rs. 5,00,000 penalty, and its own discretionary power under Section 446(3) CrPC to remit part of a forfeited bond, the Court held the forfeiture grossly excessive and reduced the amount payable to a nominal Rs. 5,000, to be deposited within six weeks.
Lesson Learnt
A "security for good behaviour" bond under the CrPC is a preventive tool, not a punishment, and its forfeiture must be proportionate to the person's means and the gravity of the alleged breach. Courts have the power, and the duty, to scale down an excessive forfeiture rather than mechanically enforce the full bond amount, especially against economically vulnerable individuals.
