Jagmal & Ors. v. State of Rajasthan
Background
Following an earlier altercation, the appellants were accused of forcibly entering a house on 19.02.2004 armed with lathis, iron rods, and an axe, and attacking the occupants; one victim, Virendra, died of his injuries the same night. The trial court convicted the appellants of murder under Section 302/149 IPC along with other offences, sentencing them to life imprisonment, and the Rajasthan High Court dismissed their appeal. The appellants argued before the Supreme Court that they had acted in the exercise of their right of private defence, since there had in fact been a "free fight" in which the other side's man (Lal Chand, who died during trial) was first attacked by the complainant's side.
Decision Breakdown
The Supreme Court did not disturb the finding that the appellants caused Virendra's death, since the eyewitness accounts were corroborated by medical evidence. However, examining the record, the Court found substance in the private-defence plea: evidence showed the deceased was beaten outside the house (matching the site plan), there was a genuine cross-case where the complainant's side had itself been charge-sheeted for assault on the appellants' side, and the appellants bore their own injury reports, none of which the High Court had properly weighed. The Court therefore held that a murder conviction under Section 302 could not be sustained, but downgraded the conviction to the lesser offence of culpable homicide not amounting to murder under Section 304 Part-I IPC. Since the appellants had already served about 11.5 years, the Court sentenced them to time already served and ordered their release (if not wanted in any other case).
Lesson Learnt
A murder conviction can be reduced to a lesser homicide offence where the evidence shows the incident arose from mutual aggression rather than a one-sided unprovoked attack: courts must weigh evidence of a genuine cross-case, corroborating injury reports, and site-plan details supporting a private-defence claim, not dismiss it outright.
