K. Priyadharshini & Ors. vs M/s Gammon India Limited & Anr.
Background
On 15 January 2013, S. Karthikeyan was riding his motorcycle on Anna Salai Road, Chennai, when it collided with a crane belonging to Gammon India Limited (insured with the second respondent). He died from his injuries. His legal heirs (the claimants/appellants) sought compensation before the Motor Accident Claims Tribunal, which found the crane's rash and negligent driving responsible and awarded about Rs. 21.34 lakh with 7.5% interest. On appeal, the Madras High Court raised the compensation to about Rs. 86.08 lakh by using Income Tax Returns to calculate income, but declined to add anything for "Future Prospects."
Decision Breakdown
The Supreme Court held that while the High Court was right to enhance the compensation, it erred in not awarding Future Prospects at 40%, which the Tribunal had originally allowed and which ought to have been upheld per the settled law in National Insurance Company Ltd. v. Pranay Sethi. The Court recalculated the award, applying 40% future prospects, 1/4th deduction for personal expenses, and a multiplier of 15, along with conventional heads (loss of consortium, love and affection, estate, transportation and funeral expenses), enhancing the total compensation to Rs. 1,06,71,710/- with 7.5% interest per annum from the date of filing the petition till realization.
Lesson Learnt
In motor accident death claims, "Future Prospects" (an addition to income to account for expected future income growth) must be added to the deceased's income as per the standard formula laid down in Pranay Sethi, and courts should not omit this component even while otherwise recalculating compensation using updated income figures.
