Karan Parcha vs. State of NCT of Delhi
Background
The applicant sought regular bail in an FIR alleging offences under Sections 376 (rape) and 506 (criminal intimidation) of the IPC and Sections 66/67 of the Information Technology Act. The allegation was that he raped the complainant, took her nude photographs and videos, and then used them to blackmail her and upload them on social media. During the hearing, the State pointed out that the applicant had concealed his history of prior bail applications, including one earlier bail application that had been filed and withdrawn.
Decision Breakdown
A Law Researcher of the Court retrieved court records showing the applicant had actually filed five bail applications (including the present one), none of which were disclosed in this application. The Court held that this non-disclosure of prior applications and their outcomes was itself sufficient grounds to dismiss the bail plea, and did so, along with the connected miscellaneous application, without going into the merits of the rape/blackmail allegations themselves.
Lesson Learnt
An accused seeking bail must fully and honestly disclose all previous bail applications and their outcomes; concealing this history can result in outright dismissal of the bail plea regardless of the underlying merits of the case.
