Krishan Kumar v. State of Haryana
Background
Police recovered five kilograms of opium from a plastic bag carried by Krishan Kumar at a bus stand. A dispute over whether the official present during the search was an Executive Magistrate led to a retrial and acquittal, which the High Court reversed. Kumar challenged that conviction and the reliability of the recovery evidence.
Decision Breakdown
The Court dismissed the appeal, leaving the ten-year prison sentence and one-lakh-rupee fine in place. Section 50 of the NDPS Act governs a search of the person, whereas this recovery came from a bag; the debate about the official's magistrate status therefore did not determine the case. The Court also noted that his status as a gazetted officer was undisputed. Having reviewed the evidence, it rejected objections concerning witnesses and delay in sending the sample for examination. The prosecution had proved guilt beyond reasonable doubt.
Lesson Learnt
The personal-search safeguard considered here did not extend to a search confined to the bag being carried. A defence must address the search actually conducted and the strength of the recovery evidence.
