Kuyadat Ali and Ors. v. State of U.P. and Ors.
Background
The appellants had sought quashing of an FIR registered on 1.10.2016 at Police Station Kotwali, District Etawah, Uttar Pradesh. The Allahabad High Court declined to quash the FIR but granted protection from arrest to some of the appellants, subject to their cooperating with the investigation. The matter reached the Supreme Court, which on 6.1.2017 had already extended similar protection to the remaining appellant and directed all of them to cooperate with the investigating officer.
Decision Breakdown
By the time the matter came up again on 13.2.2017, the investigation had been completed and the final police report under Section 173(2) Cr.P.C. had been filed, and the trial court had already summoned the appellants. The Supreme Court held there was no purpose in keeping the appeal pending any further. It directed the appellants to surrender before the Trial Court, which was in turn directed to release them on bail on furnishing bail bonds of Rs. 10,000 each with two sureties. The Court expressly clarified it had not examined the merits of the underlying allegations.
Lesson Learnt
Where a party has already received interim protection from the Supreme Court and the criminal investigation reaches its natural conclusion (chargesheet filed, accused summoned), the Court will often simply route the accused back to the trial court with a bail direction rather than keep deciding the quashing petition: case management and avoiding unnecessary pendency is as much a part of court practice as the underlying legal merits.
