Lachoo Ram and others v. Himachal Road Transport Corporation
Background
The family of a motorcyclist who died near a Shimla traffic signal claimed compensation from the bus corporation. The Tribunal awarded Rs. 2,74,000, but the High Court reversed that award. The dispute concerned both whether the bus was involved and whether its driver caused the accident through negligent driving.
Decision Breakdown
The Supreme Court dismissed the family's appeal and left the denial of compensation in place. On the balance of probabilities, it accepted that the bus and motorcycle were involved in the accident. That finding alone, however, did not prove the driver's negligence for this claim. The evidence showed a narrow road and the motorcycle attempting to overtake as traffic began moving; the reliable witness did not see the impact or describe a sudden turn by the bus. The Court found the High Court's reasons for rejecting negligent bus driving more persuasive than the Tribunal's reasons.
Lesson Learnt
In an accident claim based on negligence, identifying an involved vehicle is only part of the proof. Evidence must also explain how the driver's conduct caused the accident, even though the civil standard of proof is lower than in a criminal trial.
