Mahavir Singh v. State of Haryana
Background
Suraj Mal went missing and his body was later found in a canal. Mahavir Singh and another accused were convicted of murder, conspiracy and disposal of evidence, based on last-seen testimony, medical findings and recoveries. Mahavir challenged the time gap, the recovery evidence and the failure to examine independent witnesses.
Decision Breakdown
The Court dismissed his appeal and upheld the convictions. The medical estimate placed the death close to when the victim was last seen with the accused, despite the later recovery of the body. Bloodstained clothes and other articles recovered following disclosures supported the prosecution's chain of circumstances. The discrepancies identified were minor, and relevant witnesses had not been asked during cross-examination to explain several points later raised on appeal. The co-accused's separate appeal was left for another hearing.
Lesson Learnt
A delayed discovery of a body does not by itself defeat last-seen evidence when medical findings place death close to that sighting and other circumstances support guilt. Challenges to explainable evidentiary details should be put to the relevant witnesses during cross-examination.
