Manasvi Jain v. Delhi Transport Corporation
Background
Manasvi's father, a fifty-five-year-old government engineer, died in an accident caused by negligent bus driving. The compensation calculation used salary after deductions for provident fund, housing, insurance and income tax. The High Court declined enhancement, and Manasvi challenged both the income calculation and interest rate.
Decision Breakdown
The Supreme Court allowed the appeal and increased compensation to ₹16.15 lakh with six per cent annual interest from the claim petition until payment. Income tax could be deducted from salary, but the other contributions in this case represented savings or benefits for the family and should not reduce the income used for dependency loss. The Court rounded the resulting monthly figure to ₹25,000 and retained the multiplier of eight and one-third personal-expense deduction. Its revised total included the existing funeral and mental-agony amounts. The decision corrected this calculation rather than prescribing every component of compensation for all future cases.
Lesson Learnt
A family's dependency claim should not be understated by deducting provident fund and similar savings from the deceased's income. The relevant calculation here deducted income tax while retaining those family-benefit contributions.
