Manoj & Ors. vs. The State (Govt of NCT of Delhi) & Anr.
Background
The petitioners (husband and family) sought quashing of an FIR lodged by the wife alleging cruelty and dowry-related offences after the couple, married in 2022, began living separately due to temperamental differences. A charge-sheet had already been filed by the time the parties reached a settlement.
Decision Breakdown
The parties had already obtained a mutual-consent divorce and signed a detailed Memorandum of Understanding. The wife confirmed in court that she had received a full and final settlement of Rs 2,20,000 (partly already paid, balance paid that day by demand draft), plus agreed household articles, and that she had no objection to the FIR being quashed. The Court held that continuing a purely private dispute with no public-interest element would serve no purpose once genuinely settled, and quashed the FIR under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Lesson Learnt
Even after a charge-sheet has been filed, a matrimonial FIR can still be quashed by the High Court if the couple later reaches a complete, voluntary settlement confirmed directly to the Court by the complainant.
