Manoranjana Sinh @ Gupta v. Central Bureau of Investigation
Background
The appellant, arrested in connection with FIR RC-04/S/2014-(SIT) Kolkata relating to the Saradha Group financial scam, had earlier been granted bail by this Court's order of 6 February 2017 on furnishing a bond of Rs. 1 crore along with two local sureties of like amount. She subsequently filed a miscellaneous petition asking the Court to modify/clarify some of the bail conditions.
Decision Breakdown
The Court (Arun Mishra and Amitava Roy, JJ.) modified paragraph 19 of its earlier bail order to clarify that the appellant was not required to make a cash deposit of the bond amount, furnishing the bond itself would suffice, and relaxed the requirement that the sureties be local residents. All other terms of the original bail order were left intact, and the modification petition was disposed of accordingly.
Lesson Learnt
Even after bail is granted, the same bench can be approached to clarify or soften the practical conditions attached to it (e.g., cash deposit vs. bond, local-surety requirements) without re-litigating the merits of the bail grant itself.
