Mohd Savid Mohd Shabid & Ors. vs. The State (Govt of NCT Delhi) & Anr.
Background
A husband and his relatives faced an FIR for cruelty and criminal breach of trust filed by his wife after their marriage broke down. The couple had a daughter together but began living separately due to differences. The dispute was referred to mediation, where the parties reached a full settlement and obtained a divorce under Muslim personal law (Khulanama).
Decision Breakdown
The Court quashed the FIR after directly verifying with the wife (present in court with her brother) that she had received Rs. 7,00,000 as full and final settlement of all her claims, including past, present and future maintenance, alimony, stridhan, and mehr, and that she had entered the settlement voluntarily, with no pressure from anyone. Custody of the daughter was to remain with the mother, without prejudice to the child's own legal rights. Since it was a private matrimonial dispute with no larger public interest, the Court found continuing the criminal case pointless.
Lesson Learnt
Courts will readily quash matrimonial cruelty FIRs once a genuine, voluntary, and complete financial settlement is reached and verified directly with the complainant, but any arrangement about a child's custody or maintenance in such a settlement cannot override the child's own independent legal rights.
