Mukhtar Khan v. State of Chhattisgarh
Background
The appeal arose from a matrimonial dispute between a husband and wife in which multiple proceedings had been initiated against each other, a maintenance case under Section 125 CrPC, a complaint under the Domestic Violence Act, an appeal against a divorce decree, and a criminal FIR, across courts in Chhattisgarh and Uttar Pradesh. During the pendency of the appeal before the Supreme Court, the couple reached a settlement dated 24.04.2015.
Decision Breakdown
The Supreme Court noted that the terms of the settlement had already been acted upon and that the wife had received the agreed amount. In the interests of justice, it held that the various criminal and family-court proceedings between the parties should not be pursued further, and accordingly quashed all four pending proceedings (the Section 125 CrPC case, the Domestic Violence Act case, the divorce-decree appeal, and the FIR and connected case). The appeal was disposed of on this basis.
Lesson Learnt
When estranged spouses reach and genuinely act on a mutual settlement, courts, including the Supreme Court, can quash the web of related civil and criminal proceedings between them rather than forcing the parties to keep litigating matters they have already resolved between themselves.
