Nagendra Ray v. State of Bihar & Anr.
Background
The appellant's son was killed during a political clash following the 2024 Lok Sabha elections in Chhapra, Bihar, when a mob allegedly shot him and three others. The father challenged three Patna High Court orders that had granted anticipatory or regular bail to three accused persons, arguing the High Court ignored key video footage of the incident.
Decision Breakdown
The Supreme Court found that the High Court had completely omitted to consider police video footage and related witness statements identifying the accused when granting bail, and in one instance had merely recorded the investigating officer's submissions without independent reasoning. Citing its own precedent that "reasons are the backbone of all judicial decisions," the Court set aside all three bail orders and remitted the applications to the High Court for fresh, reasoned consideration, while letting the accused continue on interim bail in the meantime.
Lesson Learnt
A court granting or denying bail must independently engage with material evidence already on record, such as video footage: simply reciting a party's submissions without analysis can get a bail order set aside and sent back for fresh consideration.
