Nagesar v. State of Chhattisgarh
Background
Following an altercation over drug and liquor consumption, a group attacked Korma Rao with weapons and he died. Nagesar and Khetro were among those convicted, with the High Court reducing the murder conviction to culpable homicide and imposing six-year terms. They argued that their presence and participation had not been reliably established.
Decision Breakdown
The Court allowed both appeals, acquitted the appellants and directed release unless required in another case. Their names were absent from the first information report, and the eyewitness accounts did not reliably establish their participation or a shared unlawful purpose. Mere presence or association with other accused was insufficient without evidence that they intended or knew of the offending act. The Court gave them the benefit of doubt rather than holding that no fatal group attack had occurred.
Lesson Learnt
Being near accused persons does not automatically make someone guilty of their violence. Group liability requires reliable evidence connecting the individual to the unlawful assembly and its common object.
