Neeraj vs. State of NCT of Delhi & Ors.
Background
Neeraj's vehicle struck and fatally injured an elderly pedestrian on a road near Jharoda Kalan, Delhi, in 2024, leading to an FIR for rash driving causing death. The deceased's legal heirs separately pursued and settled a Motor Accident Claims Tribunal case for Rs. 8,00,000, and later also executed a Deed of Settlement in the criminal case, confirming they held no further grievance and did not wish to pursue the prosecution.
Decision Breakdown
With the complainants (the deceased's family) present via video conference and confirming the settlement was voluntary, and the State raising no objection, the Court applied the Supreme Court's Gian Singh principles on quashing proceedings that are predominantly civil/compensatory in nature where continuing them would be unfair or futile. It quashed the FIR and all consequential proceedings.
Lesson Learnt
Even a death-causing traffic accident case can be quashed by the High Court once the victim's family has been properly compensated (including through the separate accident claims process) and genuinely no longer wishes to pursue criminal charges, since continuing would serve no real purpose for anyone.
