Pappu Mandal & Ors. vs. State of NCT of Delhi & Anr.
Background
A husband and his family faced an FIR for cruelty and breach of trust after his marriage broke down. The couple had one daughter, who remained with her mother. The parties reached a Memorandum of Understanding with the help of friends and relatives, and had already obtained a mutual consent divorce.
Decision Breakdown
The Court quashed the FIR after confirming with the wife (present in person) that she had agreed to accept Rs. 3,00,000 as full and final settlement for alimony and maintenance, of which she had already received the full amount (including the balance paid on the day of the hearing), plus an ongoing monthly maintenance arrangement for the daughter that would increase after four years. The Court clarified this settlement could not curtail the daughter's own independent legal rights, and finding the dispute private with no public interest, quashed the case.
Lesson Learnt
A complete and voluntary financial settlement, verified directly by the court with the complainant, and with the full amount actually paid, is usually sufficient to end a matrimonial criminal case, but any provision for a child in the settlement is never treated as final or exhaustive of the child's own rights.
