Pardeep Singh vs. State NCT of Delhi & Anr.
Background
A wife had filed an FIR in 2021 against her husband and mother-in-law alleging cruelty and misappropriation of her belongings (Sections 498A/406 IPC) after the marriage broke down due to temperamental differences. The mother-in-law had already been discharged earlier. The couple later obtained a mutual-consent divorce and signed a comprehensive settlement resolving all disputes, including maintenance, alimony and jewellery claims.
Decision Breakdown
The complainant appeared in person, confirmed the divorce and settlement were genuine and voluntary, and stated she no longer wished to pursue the case. The Court held that continuing a purely private matrimonial dispute serves no public interest once the parties have separated by mutual consent and settled all claims, and quashed the FIR and all related proceedings against the husband.
Lesson Learnt
Once a divorced couple has genuinely and fully settled their matrimonial disputes, criminal cases arising from the marriage's breakdown (like cruelty or misappropriation allegations) can be quashed, since prolonging them serves no one's real interest once both sides have moved on.
