Praveen Kumar C.P. vs Kerala Public Service Commission & Ors.
Background
In an earlier civil appeal (C.A. No. 4846/2021) decided on 17.08.2021, the cause title of the judgment mistakenly repeated the respondent's name twice, reading "Kerala Public Service Commission Commission & Ors." A miscellaneous application was filed by court's own motion to have this clerical error corrected.
Decision Breakdown
The Supreme Court allowed the application for correction of the cause title. It directed that the respondent's name in the earlier judgment be corrected to read simply "Kerala Public Service Commission & Ors." instead of the erroneous doubled version. All pending applications, if any, were disposed of.
Lesson Learnt
Courts retain the power to correct clerical or typographical errors in a judgment's cause title even after the judgment is pronounced, through a simple miscellaneous application: parties need not fear that a minor drafting slip in the case title affects the substance of a decision.
