Rakesh Verma @ Rakesh @ Rinku vs. State NCT of Delhi & Anr.
Background
A husband sought quashing of a 2013 FIR filed by his wife under Sections 498A/406/34 IPC, on the ground that the couple had since reconciled. The wife, present in court, confirmed that she and the husband now had a child together, were living happily as a family, and that she no longer wished to prosecute him.
Decision Breakdown
Having personally spoken with the complainant in Hindi and being satisfied that the reconciliation was genuine, the Court held it would serve the interest of justice not to push the parties through a full trial. The FIR and all proceedings arising from it were quashed.
Lesson Learnt
Where a matrimonial dispute has genuinely been resolved and the couple is living together as a reconciled family, courts will often quash the criminal case rather than force both parties through a disruptive and unnecessary trial.
