Ratna alias Ratan Lal v. State of Rajasthan
Background
A householder reported that intruders had broken his lock and stolen jewellery and cash in December 1987. Ratna and Uda were arrested, and stolen articles were recovered following their disclosure statements. Their convictions for house-breaking and theft survived an appeal and a revision, although the first appellate court had reduced their prison terms.
Decision Breakdown
The Supreme Court partly allowed the appeal by reducing imprisonment while retaining both convictions. After examining the record, it was not persuaded to depart from the findings of guilt. In light of the circumstances, including the lengthy passage of time in the proceedings, it reduced the section 454 sentence to one year and the section 380 sentence to 18 months. Those terms were to run concurrently. The fines and imprisonment in default of payment remained as imposed by the courts below.
Lesson Learnt
An appellate court may retain a proved theft conviction while adjusting punishment for the circumstances of the case. A reduction of imprisonment does not cancel fines or default sentences unless the order also changes them.
